Privacy Policy
This policy explains what Kesta Placement ("we," "us") collects when you use kestaplacement.com (the "Site"), how we use it, who we share it with, and the choices you have. If you do not agree with it, do not submit the form.
What we are and are not
Kesta Placement is a referral service. We connect merchants with payment processors, acquiring banks, independent sales organizations, and chargeback or fraud remediation providers (together, "Partners"). We are not a payment processor, acquirer, ISO, registered agent, or financial institution. We do not underwrite merchant accounts and we do not collect the documents an underwriter requires.
Information we collect
Information you give us. When you submit the form on the Site, we collect what you enter: business name, website, contact name, email address, phone number, industry, monthly card volume, business location, current processing status, and any optional fields you choose to complete, including prior processor, average ticket, years in business, chargeback, fraud, and dispute ratios, certification status, and free-text notes.
Information collected automatically. Our hosting provider and form service log standard technical data such as IP address, browser type, device type, referring page, and the date and time of your visit. We do not run advertising trackers. If we add analytics, this policy will be updated to say so.
What we do not collect. We do not ask for and do not want government identification numbers, bank account numbers, card numbers, processing statements, bank statements, or any underwriting document. Do not include these in the form or in the notes field. If you send them anyway, we will delete them.
How we use it
- To review your submission and determine whether and where we can refer you.
- To contact you about your submission by email or phone.
- To introduce you to one or more Partners that may be able to serve your business.
- To keep records of referrals we have made and to reconcile referral compensation with Partners.
- To operate, secure, and improve the Site.
- To comply with law and to enforce our Terms.
Who we share it with
Partners. The purpose of the form is to refer you. By submitting it and checking the consent box, you authorize us to share the information you provided with one or more Partners so they can evaluate whether to work with you. Once shared, a Partner's use of your information is governed by that Partner's own privacy policy and agreements with you, not by this policy. We choose which Partners receive your information based on our review; we do not broadcast submissions.
Service providers. We use third-party services to host the Site, process form submissions, provide email, and manage contacts. These providers process data on our behalf and are not permitted to use it for their own purposes.
Legal. We may disclose information if required by law, subpoena, or court order, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
Business transfers. If we sell or transfer the business, your information may transfer with it, subject to this policy.
We do not sell your personal information and we do not share it with third parties for their own marketing.
Compensation disclosure
We may receive a referral fee, commission, or ongoing compensation from a Partner if you become that Partner's customer. This compensation does not change what you pay the Partner. We do not charge you a fee.
How long we keep it
We keep submission records for as long as needed to manage the referral, reconcile compensation with Partners, and meet legal and accounting obligations, generally up to seven years from the last activity on the record. You may ask us to delete your information sooner, subject to the exceptions below.
Your choices
- Access and correction. Email us and we will tell you what we hold about you and correct it on request.
- Deletion. Email us and we will delete your information, except what we must keep for legal, accounting, or dispute purposes, and except information already shared with a Partner, which you will need to request from that Partner directly.
- Withdrawing consent. You may withdraw your consent to further sharing at any time. This does not affect sharing that has already occurred.
- Marketing. We do not send marketing email. Any message from us relates to your submission.
To exercise any of these, email desk@kestaplacement.com. We will respond within 30 days.
Residents of California and other states
If you are a resident of California or another state with a consumer privacy law, you may have the right to know what personal information we collect, to request deletion, to correct inaccurate information, and to not be discriminated against for exercising those rights. We do not sell or share personal information for cross-context behavioral advertising. Submit requests to the email above. We may need to verify your identity before acting on a request.
Residents outside the United States
The Site is operated from the United States and is intended for businesses in the United States, Canada, the United Kingdom, and the European Union. If you submit information from outside the United States, you consent to its transfer to and processing in the United States. If you are in the UK or EU, our basis for processing is your consent (for sharing with Partners) and our legitimate interest in operating a referral service (for everything else). You may lodge a complaint with your local supervisory authority.
Security
We use reputable hosting and form providers with encryption in transit, and we limit access to submission data to the people who review it. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Children
The Site is for businesses. We do not knowingly collect information from anyone under 18.
Changes
We may update this policy. The effective date at the top will change when we do. Material changes will be noted on the Site.
